Declaration

 

Be it known that I, Edmund Keli’i Silva, Jr. King of the

 Kingdom of Hawai’i, hereby declare that the entire archipelago

and surrounding seas of the archipelago belong to the Kingdom of Hawai’i.

 That all peoples throughout the world are served notice that Hawai’i

is an independent sovereign nation ordained and sustained by

the Hand and Might of a Just God in our Heavenly Father.

Dear Chief Justice Moon and Members of the Supreme Court,

 

Aloha oukou.   I approach each of you with the spirit of aloha in hopes that you will view this letter as coming from one who is deeply concerned about the future of the Constitution of the United States of America.  Although I am restoring the Kingdom of Hawai’i, I am committed also to the welfare of my foster government that I have come to know.  There are many Americans who still believe that the Government of the United States will someday open their eyes and reclaim their integrity of serving the people and not their own personal agenda.  This government once purported to be ‘Enlightened,’ yet their actions of self destruction are tantamount to treason against all the peoples of the world who once looked up to the United States as a model.

 

Unfortunately, things have changed dramatically, and the people have come to distrust rather than respect the government.  That lost respect in the Court System must be reinstated so that the people can be safe in knowing they are being served by those of the highest integrity. 

 

The Constitution, once a pono and enlightened work of art used throughout history as a model for many nations of the world in penning their own Constitution, is now in grave danger of being dismissed as only nice writings whose original authors were just dreamers.  It has become corrupted to promote political agendas and selfish interests.

 

Ironically, the people of the United States and the people of Hawai’i are having a small taste of the bitter fruit that comes when someone steals your government from you and forces you to live under conditions diametrically opposed to your beliefs.  The Hawaiian people have known that bitter taste for more than one hundred years.

 

Respectfully, I am again writing you to ask you to do the right and noble thing that your office commands.  Please consider the following:

 

You are now in receipt of the Petition for a Writ of Mandamus directed at the Circuit Court in Maui regarding the rights of those who sought to intervene in the Superferry case on November 14, 2007.

 

You are also in receipt of the Petition for an Order to Show Cause directed at the Attorney General’s Office regarding the misconduct engaged in by that office related to the continued operations of Superferry after your Order of August 23, 2007.

 

I am writing first of all to inform you that the Superferry has now delayed resumption of service until December 6, so there is a bit more time for you to address the two filings noted above.

 

My primary reason in addressing you, however, is to urge you to fill the void that has existed since your order of August 23.  That void is the complete absence of any official effort to prevent the illegal activities identified in the Order of Performance I sent you and further reported to you in the Petition for Writ of Quo Warranto I filed subsequently.

 

That absence of official action permitted the conspirators to use their public offices to continue their efforts to force through operations of the Superferry.  The conspirators used the authority of the Governor to call a special session of the Legislature and, assisted by the Attorney General interpreting the law for the Legislature, push through a law that is unconstitutional for many reasons.  I assume that issue will be before you in the near future.

 

The conspirators used the authority of the Attorney General to pursue the lifting of the injunction that prevented the Superferry from operating in the Maui harbor.  The conspirators obviously intend to use the authority of the Attorney General to continue their efforts to give continued operation of Superferry a priority over protection of the natural environment.

 

The absence of official action to stop the conspiracy, that appears to have implicated numerous members of the State and Federal governments, has left the task to my Ali’i Mana’o Nui Lanny A. Sinkin.  I have watched as he basically fulfilled the role of special prosecutor trying to find a forum that would finally step up to the responsibility inherent in holding public office.  He has worked day and night to offer opportunities to official bodies to take action.  He refused to be discouraged by the absence of a commitment to protect and preserve the institutions of government.

 

If there is still something that can be called a government in the State of Hawai’i, as opposed to a criminal gang abusing government power, the time has come to lift the burden from my Ali’i Mana’o Nui.  He has considerable responsibilities in the ongoing restoration work of the Kingdom that need his attention.

 

You spoke clearly on August 23.  You gave hope to people that the law had meaning and that politics and money could not corrupt the law.  The time has come to speak clearly again.  You dismissed the Petition for a Quo Warranto Writ because you rejected the argument in that petition that you could take original jurisdiction and asked for a pleading that would give you proper jurisdiction. 

 

What could be more fundamental than your inherent power to protect the integrity of the judicial process from abuse by officers of the court?  That is the jurisdiction offered in the Petition for an Order to Show Cause. 

 

 

 

What could be more fundamental than the due process rights of those harmed by government action to have a timely and meaningful hearing?   That is the jurisdiction offered in the Petition for a Writ of Mandamus.

 

To stay the operation of the Superferry while the conspirators are held accountable for their actions will begin to restore some integrity to the government itself.

 

I urge you to step fully into the breach created by the astonishing response of public officials to your perfectly reasonable ruling on August 23.  Put a stop to the lawless abuse of public position and deny the law breakers the benefits gained by their illegal activities.

 

The Superferry episode is a historical turning point.  Either the disintegration of the de facto government of Hawaii will be complete or the courage of your institution will shine a light from the rubble of lawlessness to begin a restoration process that will right all the substantial wrongs witnessed in these islands.
